1. Acceptance of these Terms

By creating an account, subscribing, or otherwise using PEAKD!, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App. We may update these Terms from time to time as the App evolves or as the law requires (see “Changes to these Terms” below).

2. Eligibility

You must be at least 18 years old to use PEAKD!on your own. A minor (a person under 18) may use the App only with the consent and active supervision of a parent or legal guardian, who accepts these Terms on the minor’s behalf and remains responsible for the minor’s use. We take a conservative, protective approach to younger users and may steer plans toward general well-being and guidance from a qualified professional. By using the App you confirm you meet these requirements.

3. What PEAKD! is

PEAKD! is a mobile AI fitness coaching app. It asks about your goal, schedule, equipment, eating pattern, energy and sleep, then builds a weekly training and nutrition-adaptation plan that you review and activate. Every task ships in three versions, Main (go deep), Lite (stay consistent when short on time), and Survival(keep the plan alive on a bad day), so a hard day never has to be a zero day. Each week, a Stand-up reviews what actually happened and the plan adapts: progressive overload when things go well, a recovery week when they don’t.

The App supports goals such as building muscle and strength, losing weight sustainably, boosting stamina and endurance, healthier everyday habits, building the habit (for beginners and restarters), and custom fitness goals. Nutrition guidance is adapt, don’t overhaul, small swaps, additions, portions, and timing based on what you already eat. PEAKD! does not count calories, prescribe macros, hand you replacement meal plans, log sets, reps, weights or body measurements, provide an exercise-video library, or offer sport-specific athletic training.

4. Your account

You sign in with Sign in with Apple or Google, which gives us your email address and name to create and secure your account. You may add or edit an optional display name. You are responsible for keeping access to your sign-in method and account secure and for activity that happens under your account. Please tell us promptly at sampitoffl@gmail.com if you believe your account has been compromised.

5. Subscriptions & billing

PEAKD! is a paid app. Subscriptions are offered in Indian Rupees (INR) on weekly, monthly, and yearly auto-renewable plans. The current price for each plan is shown in the app and on the App Store or Google Play before you purchase. Prices may change; any change will be shown to you before it takes effect.

• How you pay. Subscriptions are purchased and billed through the app stores (Apple App Store / Google Play) and/or our payment provider. We do not store your full card details, payment processors handle your payment information directly.
• Auto-renewal. Subscriptions renew automatically at the end of each billing period until you cancel, and your payment method is charged for each renewal at the then-current price.
• Cancelling. You can cancel anytime in your store subscription settings (Apple ID or Google Play account, or with our payment provider where applicable). Cancellation stops future renewals; you keep access until the end of the period you have already paid for.
• Refunds. Refunds, where available, are handled according to the policy of the store or payment provider you bought through. Please review their refund terms, as they govern your purchase.

6. Gains

“Gains” are internal, in-app virtual credits. They are a motivation and reward feature only.

• Gains have no monetary value. They are not money, gift cards, cash, UPI balance, vouchers, or any other instrument, and carry no cash value.
• Gains are earned through activity, by showing up and completing tasks, stand-ups, wellness actions, and similar, and are not purchased.
• Gains are non-transferable and cannot be bought, sold, exchanged, gifted, redeemed for cash or goods, or withdrawn. They can only be spent inside the App on AI coaching features.
• Gains are intended to never expire. We may change how Gains are earned, spent, priced, or otherwise operate, or discontinue the program, as the App evolves; we will not convert Gains into any form of money.

7. Acceptable use

You agree to use PEAKD! lawfully and respectfully. In particular, you agree not to:

• use the App for anything unlawful, harmful, or that endangers your safety or the safety of others;
• attempt to misuse the AI features, for example to generate violent, illegal, or self-harm content, or to manipulate, jailbreak, or reverse-engineer the coaching system;
• copy, scrape, resell, or commercially exploit the App or its content without our permission;
• interfere with the App’s operation or security, or attempt to gain unauthorised access to any account or system;
• impersonate others or provide false information when signing in or submitting content.

We design the App to respond supportively to sensitive situations, for example, steering extreme weight-loss goals toward sustainable ones, encouraging rest where overtraining is a risk, and gently suggesting professional guidance where appropriate. Requests for violence, illegal activity, or self-harm are not supported.

8. Not medical advice; assumption of risk

PEAKD! is a fitness coaching app, not a medical service, and does not provide medical advice, diagnosis, or treatment. Plans, nutrition suggestions, reminders, and coaching content are general information for healthy adults and are not a substitute for advice from a qualified doctor, dietitian, or other professional.

Physical activity carries inherent risk. You take part at your own risk. Consult a healthcare professional before starting or changing any exercise or nutrition routine, especially if you are pregnant, recovering from injury, or living with a medical condition, and stop and seek help if you feel unwell or in pain. Train within your limits and use your own judgement. If you may be experiencing a medical or mental health emergency, contact local emergency services or a professional immediately.

9. Your content

You may provide content to the App, for example imported plans (pasted text or CSV), task notes, missed-task reasons, and weekly reflections (“Your Content”). You keep ownership of Your Content. You grant us a limited, non-exclusive licence to store, process, and use Your Content only as needed to operate and improve the coaching service for you, including processing it with our AI provider to generate and adapt your plans. We do not sell your personal data. You are responsible for ensuring you have the right to share any content you import.

10. Intellectual property

The App, including its name, design, text, graphics, the Gains feature, and the coaching system, is owned by SAMP IT or its licensors and is protected by applicable laws. We grant you a personal, limited, non-transferable, revocable licence to use the App for your own non-commercial fitness use while your subscription is active and you comply with these Terms. No other rights are granted.

11. Third-party services

The App relies on third-party services to function, including Sign in with Apple and Google Sign-In (via Firebase) for sign-in, app stores and payment processors for billing, our AI provider (for example, OpenAI) to generate and adapt plans, and Expo push notifications to deliver the reminders you enable. Your use of those services may also be subject to their own terms. We are not responsible for third-party services we do not control.

12. Disclaimers

To the fullest extent permitted by law, the App is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or that any plan, suggestion, or AI-generated content will achieve a particular result. Results depend on many factors that are personal to you and outside our control.

13. Limitation of liability

To the fullest extent permitted by law, SAMP IT will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the App. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the App will not exceed the amount you paid us for the subscription in the twelve (12) months before the event giving rise to the claim. Nothing in these Terms excludes any liability that cannot lawfully be excluded.

14. Indemnity

You agree to indemnify and hold SAMP IT harmless from any claims, losses, liabilities, and reasonable expenses arising from your misuse of the App, your breach of these Terms, or your violation of any law or the rights of another person.

15. Termination

You may stop using the App and delete your account at any time from Profile → settings → delete account, or by emailing sampitoffl@gmail.com from your account. Deleting your account does not automatically cancel a store subscription, cancel that separately in your store settings. We may suspend or terminate your access if you breach these Terms or use the App in a way that harms others or us. On termination, your right to use the App ends; sections that by their nature should survive (such as Gains, disclaimers, limitation of liability, and governing law) continue to apply.

16. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you in the App. Your continued use of PEAKD! after changes take effect means you accept the updated Terms.

17. Governing law and jurisdiction

These Terms are governed by the laws of India. You and SAMP IT agree that the courts of Tamil Nadu, India have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the App. If you are in India, these Terms do not limit any rights you have under the Digital Personal Data Protection framework, including access, correction, erasure, and grievance redressal, as described in our Privacy Policy.
